A Day in the Life of an Aspiring Lawyer with Rhae Patel

As a student with a passion for law, I had the opportunity to do a work experience placement at Oluoch Kimori Advocates, and it was an exciting and insightful day for me. The exposure to a real work environment helped me gain confidence and provided me with valuable lessons that I will carry with me in my journey towards becoming a lawyer.

I learned how to effectively communicate with clients, understand their needs, and provide appropriate solutions

One of the first things I learned during my work experience was how to interact with people who are older than me. As a young student, it was initially intimidating to be in a professional setting surrounded by experienced lawyers and staff. However, I quickly learned how to communicate respectfully, listen attentively, and respond appropriately in a professional manner. I realized that building positive relationships with colleagues and superiors is crucial in a work environment, and I am grateful for the opportunity to learn this valuable skill at Oluoch Kimori Advocates.

Another important aspect of the work environment that I learned about was the formal dress code required at the workplace. I quickly realized that professionalism extends beyond just knowledge and skills, but also includes how one presents oneself. I learned how to dress appropriately in accordance with the firm’s dress code policy, and how dressing professionally can impact how one is perceived in a professional setting. This lesson reinforced the importance of maintaining a polished and respectable appearance in the workplace.

Punctuality was also emphasized during my work experience at Oluoch Kimori Advocates. I learned that time is a valuable asset in a law firm, and being punctual is crucial in maintaining efficiency and professionalism. I made sure to arrive on time for work, meetings, and appointments, and I learned how being punctual demonstrates reliability and respect for others’ time.

One of the highlights of my work experience was observing my supervisor, Advocate Lilian Oluoch, as she handled clients and discussed various legal matters such as business law, litigation, and conveyancing. I was fascinated by her expertise and professionalism in dealing with clients and providing them with legal advice. I learned how to effectively communicate with clients, understand their needs, and provide appropriate solutions. This firsthand experience gave me valuable insight into the practical aspects of being a lawyer and ignited my passion for pursuing a career in law.

I also had the opportunity to learn from the receptionist at Oluoch Kimori Advocates, who played a crucial role as the initial point of contact with clients at the firm. She patiently showed me how to take records, open new files for clients, and transfer office calls using the switchboard. I learned how important communication, organization, and attention to detail are in managing client inquiries and maintaining smooth office operations.

Overall, my work experience at Oluoch Kimori Advocates was a memorable and enriching day. I am grateful for the opportunity to have gained insights into the real-life workings of a law firm and to have learned important skills such as professional communication, dress code etiquette, and punctuality. This experience has further motivated me to pursue my dream of becoming a lawyer and has provided me with a solid foundation for my future career in law.

I would like to express my sincere gratitude to the team at Oluoch Kimori Advocates for their hospitality, mentorship, and support during my work experience. Quantifying Non-Monetary Contribution In Division Of Matrimonial Property

The presumption that the beneficial interests in matrimonial property are equal has been rebutted by the High Court in March 2017 in the case of PNN –vs- ZWN {2017)eKLR. The court noted that allowing such a supposition would create an escape for fortune seekers to gain an advantage from their spouse’s success in a divorce. Therefore, the provision of section 7 of the Matrimonial Property Act, which guarantees division based on each party’s contribution, was maintained.

The current position is that property acquired during the marriage is considered matrimonial property and is subject to a division based on the contribution of each party towards its acquisition, both monetary and non-monetary.

Production of evidence is effective for parties to use in claiming contribution

However, the courts face difficulties in assessing the net worth of a spouse who has not made financial contributions. Evidence produced by parties is crucial in establishing non-monetary contributions, and parties must present thorough evidence to make it easier for the courts to apportion their contribution.

A stay-at-home spouse cannot claim compensation if their contribution cannot be quantified. The sufficiency of the evidence is vital in aiding courts to distribute matrimonial property appropriately and fairly.

The Matrimonial Property Act does not make it easier for courts to assess non-monetary contributions. Therefore, the production of evidence becomes an effective device for parties to use in claiming contribution and assisting courts in quantifying their contribution, provided the evidence is sufficient and effectively produced.
